HELP GUYS I NEED HELP NOW!!!!!!!

I have a small dog that I purchased as a puppy and have papers and everything. There are some people who come to my house tonite at 9:00 And said i stole their dog and that my little dog is theirs. I have some pics when she was little but as with most dogs her color has litghened up some. They claim their dog was stolen by me 1 and a half years ago and just now come to me. This is not their dog and if they sue me how will i keep my dog from being taken away? I did not steal my own dog and how do i prove my innocence? GUYZ this is serious this is a family pet. They have no real proof such as a a tattoo or microchip. Please send me anything you all know regarding laws and proof or anything. Thanks anyone else ever been in this situation?

Sounds like a predicament your in, but my first question would be why did they wait so long? Was it reported as stolen? Do they have their own pictures? and I'd also look into a statute of limitations on stolen stuff in case it gets to that. But mainly in court they have to prove your guilt, you don't have to prove your innocense based on an accusation. I'd present them with all that, because if they are trying to con you out of your dog, it would probably scare them off and make them realize that you know your Sh!t (or at least make it look that way) and that your not some push over that wont be threatened by a lawsuit. i'm not too familiar with papered dogs
but if theres a pedigree and UKC/AKC or whatever papers
wouldnt the owners name be on one somwhere or the person you got it froms name
you can always contact the breeder or whoever you got the dog from to use as a witness if the case goes to court and/or you are sued for the dog or whatever but if neither of you have proof and its your word against theres i dont think the casewould hold up too much in court...

DNA, the dog and the parents, or one parent. I would let the other people know they will get the f#@&ing bill for it too. You can have a vet sample it, and have it done through what ever registry your papers come from. That will stand up in court, and I would actually offer to submit a sample through a vet if they pay for it. See what they have to say then. I would hold my ground on that, even if they get an lawyer, once he finds out what you say is true about DNA, he'll tell them to put up or shut up. No worries, I'd laugh in their faces.

dna is a what i would say to. sounds like they are just trying to blow smoke up your a$$ and get a dog for nothing. dont think youll have much trouble as long as you stick to your guns and stay adament about them paying for the tests. if they aint willing to try it makes it obvious they are just being bullish. hope it all works out for ya.

Sounds like you got all the Proof you need, You don't need to show them a Thing... They would probably have to sue you, and I don't know any Police station that would do anything about it... And when/if they sue you they'll proabably only be able to sue you for the cost of a dog.. Then You can file a Counter suite for all your costs associated with it witch would be more than the dog..

I think it was mentioned before, If they sue you, they'll have the burden of proof that you stole it.. Not the other way around.

Most (Honest???) lawyers would probably tell them it wasn't worth it.

lol i'd just tell them to F*@$ OFF and come back when they had proof and even if they did take it to court it wouldn't hold up i'd almost put money on it. I wouldn't worry about it too much.

Well today they served me and summons me to court. My dog was born on october 7 2007 and these people say that their dog was stolen one and a half years ago. This make it impossible for this to stand up. The type dog i have is actually my girlfriends little schauzer. She was black and silver as a puppy and like alot of these type dogs has changed to a lighter color. We have her papers and some vet bills i do most our vet work but we have took her. I worry that the judge will side with them beause they are well to dos with money. We went about hundred miles to pick our little pet up. What i need to know is how will we go about dna testing this dog is not their dog but i am still worried because of the way our judge is not fair abou stuff. How will i not get stuck with the dna bill? How will I go about gettin mine dna tested can i use my vet that i know isn't paid off. If i get a lawyer and they lose will they have to pay all my cost? Guys my girlfriend will be devastated if the judge were to agree with these people. Please I need to get help here quick becaue i go to court next friday. Do they not need more proof before accussing me and my family of such a crime. I am just a little worried about the way this town is run very political its about who you are and who much money you got. Please guys send men anything you all can think for me, the dna should speak for itself. what if the judge says i have to pay for all these dna tests and so fourth?

For anything to happen in court their has to be proof beyond a reasonable doubt. SO if their is no solid evidence(DNA, records) of this dog belonging to them... you should be in the clear. If someone pulled that shit with me they better come with more heat than i got

First off. I would probably stop calling the Judge a Dumbass imbred Hick before he even hears the case. that's deffinately not going to help you. and If By chance the judge caught wind of this It might lower your odds of winning this case. Just by that comment, I'm starting to get skeptical of what your telling me and wondering if there is really a Second story hear.

Why don't you post the Summons.

So we can see what it is exactly they are accusing you off. We're just getting your side of the story, Becasue they actually filed this to court, makes me believe that they think they have a case.. You are not doing any favors by not telling us their story.. The Judge WILL hear their story.. So let me say I'm begining to get Skeptical of this, But if what you say is completely true and you have the paperwork I wouldn't worry about it..

I'm not a lawyer, But I've been in Court before on the defending side of it, and We won the case, and counter Claim. Also I really like watching Judge Judy..


Things that aren't going to help you.
Calling the Judge names,
Calling them Names and interupting their Statments
Gettin Emotional and Trying to sue them for Pain and suffering. (judges hear this all the time)

Things that will help you.
Talking to the Breeder
Finding any paper or photo you have of that dog.
Getting at minimum an official Qoute for DNA testing of both your dog and the Breeders dogs..
Filing a Counter Suite for your day in Court, Your Filing Fee's and cost associated with Court and Direct Cost to your defense. (i.e. cost of DNA testing)
Politely ask the Court to award "punitive damages" as they see fit.


Remember, Their Case and your Counter Case are two Separate things, First you will need to Show the court that they are not right, and you didn't steal the Dog. Bring all your evidence and use it all.

After that, if you win the Judge will Hear why you think you deserve Money in your counter claim. Should be allot easier, Especially if you bring Reciepts and Paper work showing What money this has cost you.. If the Case is a Land Slide in your Favor, you can ask for Punitive damages.

The Judge doesn't want to hear what you think, He wants to see the proof you have. Let them Talk.. Talk is Cheap.. You need to shut up and hand papers, and photo's that "STRONGLY" contradict their statements.


If you took photos with a Digital Camera..(BEFORE THE DATE THE CLAIMED YOU STOLE IT) then there is hidden Data on those pictures that you can offer the Judge that most cameras will show, the date the photo was taken, The Camera that was used to take it, and often the Serial Number of the camera used. It will also have the photo settings and some other data.

Don't ever assume your word is good enough and you don't need to back it up with any papers or documents.. Not in court.. Always back it up by Clear evidence.

If you said you didn't, and they said you did.. and that's all you have.. You still have the advantage, and will probably win, But you won't get any money and you probalby won't win your counter claim.
