I know it was on BGH a while ago but I have spent the last two days looking for a topic that had to deal with rights we still possess once u are stopped by the police/game warden. To be exact it was a post that was like it was written to the officer letting them know which of your rights you were choosing to exercise if anyone knows where it is hiding help me out please.

Like I said looking for a specific post regarding the rights you can (in my case should) invoke and exersize. I'm fed up with being stopped and questioned for 30-45 min and then (now that they have buttered you up) the "so you don't mind I'm going to search your pickup". just wanting to be a good citizen having nothing to hide I say yes, and short of pulling the seats out they gut my pickup and I'm tired of it. Don't know about the post your looking for but one thing that has helped me in the past is be pleasant and tell them that you need to record your conversation. This will help if you ever have to go to court, also makes them play by the law not what they think the law is.

Never let them search your vehicle without a warrant! If they do it anyway,and some will,try to get pictures or record it in some way. Even then they may confiscate your camera or whatever.Never resist them in anyway .Then call the office of the State Police and file a complaint .

There is absolutely no doubt that hound hunters are targets when in the sights of the Wardens. This is something every hound hunter should have at all times. It's currently in the making but once it launches, I think it will keep officers on their toes and not abusing their authority.

Ya I hope some one was apart of that topic and can point me in the right direction. I have seen that some of you say never let them search your pick up but in my second post I linked an artical that says they can search ur pick up for illegal game without a warrent it was contested and went all the way to the US Supreme Court where they took no action upholding CA Supreme Court ruling saying that wildlife conservation is more important (than what our 4th amendment). So is this it are we going to keep getting out pickups torn apart and can't do anything but watch?

The citizens are the final check on what goes, not the supreme court. Furthermore, the supreme court ruled, any law that is repugnant of the constitution is immediately null and void. Please READ, Marbury vs. Madison.

Now of course most citizens, lawmakers and "law enforcement" don't know and in the case of "law enforcement", many don't care.

The previous poster's advice is the most sound, record any contact with "law enforcement", do not ever consent to any search without warrant. Ask for a supervisor to come. You might have to wait, but often once the superior arrives they let you go.

The supreme court just rules that they CANNOT take your camera from you for filming them. You can sue them if they due for deprivation of rights. Report any violation of your rights to the department that detained you, the press, etc. Make a stink, call your state and federal reps.

Remember hey DO NOT have the right to stop you without probable cause. Simply ask them if you are being detained. Yes, under suspicion of what, you ask. No, then ask them if you are free to go. Keep repeating the questions. Ask for a supervisor. Do whatever you have to do. " Law enforcement" is ALWAYS fishing for something to get you on. Its really sad. So keep your mouth shut! Repeat the questions, let them know you will not answer any questions without your lawyer present.

I think the point here is that they have to have probable cause even in California,if not then you live in a police state.Tell them you do not consent to a search of your vehicle but do not resist them in any way.Also don't engage them in conversation ,they're just hoping you'll say something that will give them probable cause.If they do something you believe is illegal always,ALWAYS file a complaint you might just save the next guy from being harassed!

Say nothing, when asked say less.
1. I refuse to waive my fifth Amendment right to remain silent.
2. Do not ask me any questions without my attorney present.
3. I do not consent to any search of myself or any of my possessions.
4. If I am not under arrest, please allow me to go.
5. Any statement that I have made in response to your questions, has been under duress.

I would get an attorney to review and advise the above based on the state that you live in.

Yep that's it that's what I have been looking for thank you I was planing on printing that out on a card or something and when I get stopped and asked for my paperwork hand them that with my info should work. But ya I'm going to get in touch with a lawyer and have him review it

Some very good advice here. The old wardens understood our rights. Most of the younger wardens act like everyone is guilty of something. I'm to the point of driving by the warden and making them use the lights to stop me. I'm assuming not stopping to visit gives them probable cause, in their minds. Especially bad when wardens aren't locals. Really I've never had trouble with any local wardens.
